PulsGPT.com service rules Effective Date: May, 11, 2024

• Day - A consecutive 24-hour period.
• Guest - A physical person-user of the Website who does not have an Account or is not authorized.
• OLX – An online classifieds platform.
• PulsGPT – A service for intelligent automation of communication on OLX.
• OpenAI - A research organization focused on developing artificial intelligence technologies.
• Client - A user who is a physical person engaged in activities on the Website not directly related to their business or professional activities.
• User - A physical or legal entity, or a separate division, endowed with legal capacity and using the Website after logging into an Account.
• Account - A collection of data related to a specific User, including information about their actions on the Website and information provided by the User on the Website. Rules regarding the Account are outlined in section 3 of the Rules.
• OLX Account - A collection of data related to a specific User on the OLX Website and information provided by the User on the OLX Website.
• Rules - The current Rules, including appendices, that define the principles of using the Website. The latest version of the Rules can always be found on the Website.
• Registration - The process of creating an Account by a User after providing relevant data, accepting the Rules, and activating the Account.
• Website (Service) - The online platform PulsGPT, which is available at the domain pulsgpt.com.
• OLX Website (OLX Service) - The online platform OLX, which is available at the domain olx.ua.
• Listing - A collection of information regarding a specific advertising proposal, stored in the OLX User's account.
• Bot - An automated software solution on the PulsGPT platform, designed for conducting dialogue with clients through listings on the OLX platform. Bots are configured by users to automatically perform specified actions, such as sending predefined responses or generating responses using GPT technology, depending on the content of incoming messages.
• Connection - A permission issued within the PulsGPT service that allows a user to link a specific OLX listing to one of their bots. The connection is valid for a limited time and enables the bot to process messages received on a specific listing for the purpose of automating communication.
• OpenAI Token - A unit of measurement for information used within the GPT technology by OpenAI. A token can represent a single word or a part of a word, depending on the context and complexity of the text.
• GPT Token - A unit of tariffication for obtaining responses from the OpenAI artificial intelligence model used in the PulsGPT service. The cost of a response is calculated by multiplying the number of used OpenAI Tokens by a multiplier determined by the selected AI model. The multiplier reflects the complexity and resource intensity of the model.
• PulsGPT Account - A free feature of the Account, described in section 10 of the Rules, which simplifies payments to PulsGPT.
• Paid Services - Paid services provided by PulsGPT to the User, namely Connections and GPT Tokens.

1. Terms of Use: The terms of use of the Website, including rules for Registration, creation and use of Bots, purchase of Paid Services, as well as matters related to payment procedures and filing complaints, are outlined in the Rules. Every user of the Website is required to familiarize themselves with the content of the Rules.
2. Functional Description:
   1. Keyword Automation: Users can configure the service to automatically respond to incoming messages based on predefined keywords.
   2. Use of OpenAI's GPT: Users can set up the service to process incoming messages using OpenAI's GPT technology.
   3. Communication with OLX clients who reach out via listings in various OLX accounts within the PulsGPT interface.
   4. Advanced management and filtering of dialogues with clients.
3. Service Use Agreement: Using the PulsGPT service implies full agreement with these Rules. If a user disagrees with any of the provisions of these Rules, they should refrain from using the service.
4. Changes to the Terms of Use: PulsGPT reserves the right to make changes to these Rules at any time. After changes are made, the updated version of the Rules will be published on the service's website. Continued use of the service after the publication of changes constitutes the user's agreement with the updated Rules.
5. Legal Compliance: Users must use the PulsGPT service in strict compliance with the laws of the country in which they are using the service. All actions taken through the service or related to its use must be lawful and comply with both local and international laws. Users are also required to adhere to the rules of the OLX platform, which is necessary for interaction with this platform through the PulsGPT service, to ensure their legal and ethical interaction with other users and content.
6. Requirements for Full Website Use: To fully utilize the Website, the device connected to the Internet must meet the following requirements:
   1. A continuous Internet connection that supports bidirectional communication via the HTTPS protocol;
   2. A correctly installed and configured web browser of the latest version that supports HTML5 standard and CSS3 technology, such as Google Chrome, Mozilla Firefox, Opera, Microsoft Edge, Internet Explorer;
   3. Support for JavaScript and cookies enabled (usually enabled by default in browsers).
7. Dependency on External Services: PulsGPT depends on the stability and availability of services from OLX and OpenAI, among others. While PulsGPT has no control over these services and is not responsible for their operation, it strives to ensure that its service is reliable and continuously available. However, interruptions in operation or changes in the services from OLX and OpenAI may affect the functioning of PulsGPT.
8. Efforts to Maintain Uninterrupted Service: PulsGPT makes every effort to maintain uninterrupted operation of the Website. In striving to provide high-quality services and effective operation of the Website, PulsGPT reserves the right to suspend the operation of the Website under the conditions described below:
   1. Technical breaks may be conducted during nighttime hours (22-06), during which some functions of the Website and services provided by PulsGPT may be limited or unavailable.
   2. Technical failure - the occurrence of a technical error due to circumstances for which PulsGPT is responsible, including failure in external services from OLX, OpenAI, and others.
9. Users who communicate with other Users through the chat feature on the Website acknowledge that these conversations are not confidential, and their content may be collected by PulsGPT. By accepting these Rules, the User acknowledges that PulsGPT has the right to access and analyze the content of conversations conducted through the chat feature on the Website, in order to enhance the security of Users, prevent abuse, and improve the quality of the Website. More detailed information about how and why PulsGPT accesses and analyzes the content of conversations conducted through the chat feature on the Website can be found in the Privacy Policy.

1. To use the functionality of Paid Services, a Guest must register an Account and begin using the Website as a registered User. The Account includes, among other things, the following website functionalities: a. Creation and management of Bots; b. Viewing own Listings from multiple OLX accounts; c. Connecting and disconnecting Bots to/from Listings; d. Managing payments and accounts associated with services provided on the PulsGPT Site; e. Receiving messages from OLX Users and sending responses to them. The ability to initiate dialogue is absent; messages can only be sent after another OLX user has initiated the dialogue.
2. User Eligibility: Only a natural person with full legal capacity, a legal entity, or a separate division can be a User. In the case of legal entities and separate divisions, only a person authorized to act on their behalf can create an Account and perform any actions on the Website.
3. To register an Account, you must: a. Fill out a form available on the Website and provide necessary information, including your email address or phone number of a Ukrainian mobile operator, and a unique password or authentication via an external service provider such as Facebook, Google, or Apple; b. Familiarize yourself with the Rules and their appendices, accepting their terms.
4. PulsGPT processes the personal data of Users, persons acting on behalf of Users, and Guests in accordance with the Privacy Policy and the Policy on cookies and similar technologies.
5. After filling in the necessary data for registration, a registration confirmation, an Account activation link, and the current Rules will be sent to the User's provided email address. Registration is completed when the User activates the Account. At this stage, a service agreement for the Account is concluded. The activation link expires 30 days from the receipt of the registration confirmation email; if activation is not completed during this period, the Account will not be operational.
6. The User guarantees that the data provided during Registration and use of the Website are accurate, correct, and up-to-date, and that they have the right to use this data. The User is obligated to update the data if it changes. PulsGPT reserves the right to block the Account if the provided data does not meet the requirements outlined above, according to the procedure set out in Rule 10.
7. A person using the Website on behalf of a User who is a legal entity or a separate division confirms that they are duly authorized to act and perform all actions on the Website on behalf of such User.
8. The User must keep the Account access data confidential and protect it from access by unauthorized third parties. The User must immediately inform PulsGPT if they become aware that unauthorized third parties have gained access to the Account, and if possible, immediately change the access data.
9. The agreement for the service of the Account is concluded for an indefinite period after its activation. The service agreement for the Account may be terminated by the User in accordance with the following rules: a. The right to delete the Account does not affect the User's right to withdraw from the contract or terminate it, as provided by law and these Rules; b. The Account can be deleted by: (i) selecting the appropriate option on the Account panel, (ii) sending a statement of deletion to the email address; c. After the User deletes the Account, any remaining agreements between PulsGPT and the User regarding services provided on the Site lose their validity; d. Termination of the Account Agreement takes effect immediately (for the future), meaning that payments made by the User will not be refunded. PulsGPT is also not obliged to return the equivalent of unused amounts under the Paid Services; e. After deleting the Account or terminating the Account Agreement, the User loses access to information provided or created during the use of the Website.
10. PulsGPT has the right to terminate the contract with the User if the User: a. Has not logged into the Account for 12 months. In this case, the User will no longer be able to use the remote Account. Information about the termination of the contract will be sent to the User 30 days in advance to the email address provided at registration. If the User wishes to continue using the Account using the features provided for this purpose, they will need to log into the Account. PulsGPT's right to terminate the contract according to this provision does not limit the User's right to re-register on the Website. However, PulsGPT does not guarantee that the current Username associated with the Account will be available for use during the new registration; b. Despite PulsGPT's demand to cease certain actions or inactivity that violate the provisions of the Rules or generally accepted legal norms, continues the actions specified in the relevant demand, or does not perform the actions referred to in the demand by PulsGPT.
11. To ensure the proper functioning of the Service and the protection of users' security, PulsGPT reserves the right to conduct additional verification of the authenticity, currency, and truthfulness of the data provided by the User, requesting confirmation of their identity. If attempts to confirm data or identity fail, PulsGPT may suspend or block the Account under the terms set out in Rule 10.
12. Client's right to withdraw from the contract. Within 14 days from the date of entering into the contract with PulsGPT, the Client may cancel it without stating a reason by sending the appropriate notice to the PulsGPT support service email address. Following the cancellation of the account service contract, the effect of any other contracts binding PulsGPT and the User is terminated.
13. The Agreement for the service of the Account may be terminated by the User in accordance with the rules of paragraph 3.10. upon refusal to accept changes in the Rules, as the User will be informed in accordance with par. 12.1. b. In such a case, to terminate the Agreement for the service of the Account, the User must not later than 15 days from the announcement of the changes, notify PulsGPT of their intention. Termination of the Agreement by the User concerning the service of the Account takes effect 15 days after the User notifies of the changes in the Rules, unless the User fails to notify of their intentions, makes the corresponding statement, or does not perform clear actions on the Website that confirm the acceptance of such conditions (for example, posting a new Listing).

1. Registration and Management of OLX Accounts The process of connecting OLX accounts to the PulsGPT service: Authorization via OAuth: To connect an OLX account to the PulsGPT service, the user must enter the name of the desired account and press the connect button. This action redirects the user to the OLX website for authorization and to grant PulsGPT access to the account. Access is granted for a limited term of 30 days, after which the user must renew access.
2. Conditions for Connecting Accounts: a. The first account is connected without checks and restrictions. b. The second and third accounts must have been registered on OLX for over three months or have a “business” status. c. The fourth and fifth accounts must have had service packages purchased in the past (even if they are currently inactive). d. Starting from the sixth account, each must have an active and purchased service package at the time of connection.
3. Access Renewal The process of renewing access to OLX accounts is similar to the connection process. The user must press the renewal button next to the specific account in the PulsGPT interface. This redirects the user to the OLX website for reauthorization and to grant the necessary permissions to continue using the account. The term of the new permissions also lasts for 30 days.

The user who creates a bot and uses it to send messages on the OLX platform bears full responsibility for the content of those messages. The PulsGPT service only provides tools for creating and managing bots, without controlling or editing the texts generated or sent by bots.

1. User Obligations: Users must comply with all applicable laws and regulations of the country in which the service is used, as well as strictly adhere to the usage rules of the OLX platform when creating and disseminating messages through bots. This includes, but is not limited to: a. Laws regulating e-commerce, personal data protection, antitrust legislation, and advertising rules; b. OLX rules regarding the content of listings, interaction with other users, and the prohibition of using automated systems for entering information without explicit permission from OLX.
2. Prohibited Content: Users are prohibited from using bots to create or distribute messages that: a. Contain offensive, threatening, libelous, pornographic, indecent, or otherwise illegal material; b. Promote illegal activities, including but not limited to fraud, drug trafficking, and the distribution of harmful software; c. Infringe on the rights of third parties, including patents, trademarks, trade secrets, copyrights, or other proprietary rights.
3. Consequences of Violations: In the event messages are found that do not comply with the above requirements, PulsGPT reserves the right to: a. Immediately suspend or delete the bot, as well as block the user’s account; b. Take legal actions to protect its own interests or the interests of third parties; c. Report the violations to the appropriate law enforcement authorities.
4. Ownership and Use of Content Created by Bots: All content created by bots within the use of the PulsGPT service remains the property of the user who created the bot. However, by registering and using the PulsGPT service, the user grants the service a non-exclusive, royalty-free right to use such content for the purpose of: a. Improving and optimizing the operation of the PulsGPT service, including but not limited to developing new tools, features, and algorithms. b. Ensuring compliance with legislation and platform rules by analyzing and filtering content created by bots to prevent violations. c. Conducting research and data analysis to improve the user experience on the platform.

The use of content created by bots by the PulsGPT service is strictly functional and aimed at enhancing the quality of user service, as well as complying with the requirements of current legislation. Users retain the right to control the dissemination and use of their content according to privacy settings and service rules.

1. Usage of Connection: To activate a purchased connection, the user in the PulsGPT service selects an OLX listing to which they wish to connect a bot. After selecting the listing, the user chooses one of the bots they have created and presses the "Activate Connection" button to confirm the link.
2. Validity Period for Activation: After the connection is credited to the user’s account, it must be activated within 30 days. An unactivated connection will expire after this period.
3. Duration of the Connection: An activated connection remains valid for 30 days from the moment of its activation. During this time, the bot will automatically respond to messages in the relevant listing.
4. Release and Reuse: The user can disconnect the bot from the listing at any time, which automatically frees up the connection. The released connection can be reused to link another listing with any of the user's bots until the end of its original term. The release or reuse of the connection does not affect the overall duration of its validity.

1. Token Count Calculation: The number of tokens in a request is determined by the OpenAI service after processing the request. The total number of tokens in a request includes the tokens used in the request itself and in the response received. Components of the request to OpenAI:
   • System text, invisible to the user.
   • Text from the bot's configuration fields such as "Product or Service Information" and "Instructions for GPT".
   • Text of the current message forming the response.
   • Text from the dialogue history as defined by the bot’s history depth settings.

1. Response Length Limitation: The length of the response from OpenAI is limited by the bot parameter "Maximum Number of Tokens".

1. Validity Period for Use: After GPT tokens are credited to a user's account, they can be used within 30 days. Unused tokens will automatically expire after this period.
2. Tariffication: The number of tokens deducted from a user’s account for a response using GPT OpenAI is determined by multiplying the number of OpenAI tokens by the rate multiplier of the chosen GPT model.
3. Additional Terms: PulsGPT reserves the right to adjust the token rates in accordance with changes in OpenAI's tariffs. Users will be notified in advance of any changes.

1. On the website, users are visually informed about the current price of selected Paid Services. All prices listed on the website are gross prices expressed in the national currency.
2. Payments made within the Service must be paid in advance - in full, as required for the order of the Paid Service, before the commencement of its provision - using the payment forms provided by PulsGPT.
3. The provision of the Paid Service shall commence after the full amount has been credited to the PulsGPT account for such Paid Service.
4. At their discretion, users may make a payment using one of the available payment methods according to the information provided during the selection of this service, following the payment instructions in the PulsGPT Account.
5. The use of any payment method (other than payments from the PulsGPT Account) will require establishing separate legal relations with the payment service provider and accepting its rules. PulsGPT is not a party to such relations and cannot interfere with their content or execution. In case of payment issues, the user should contact the relevant operator to clarify any doubts or lodge a complaint. PulsGPT is not responsible for payment services provided by external service providers.
6. Funds for properly provided services are non-refundable. If PulsGPT finds a possibility to refund money for services that were properly provided, such refunds can only occur no more than once every six months per account.

1. Within the User Account, PulsGPT allows the user to use the PulsGPT Account service for free, which simplifies settlements with PulsGPT for ordered Paid Services. To avoid misunderstandings, the PulsGPT Account service is not a payment service, and the units transferred to the PulsGPT Account are not electronic money within the meaning of payment services provisions.
2. The use of the PulsGPT Account is subject to the following rules:
   a. The user must make a deposit to the PulsGPT Account by transferring funds to the PulsGPT account in one of the accepted currencies according to the information provided in the service.
   b. Once the payment is credited to the PulsGPT account, PulsGPT allocates to this user's PulsGPT Account a number of units equal to the paid amount. This balance is continuously updated after each user transaction that leads to a change in its amount (account top-ups increase the number of units in the PulsGPT Account, payments for a specific Paid Service decrease the number of units in the PulsGPT Account).
   c. The user may fully manage the funds assigned to his PulsGPT Account throughout the duration of the account service agreement, provided that the Account remains active.
   d. If payments are made from the PulsGPT Account for a specific Paid Service, PulsGPT deducts the appropriate amount needed to provide that Paid Service from the user's PulsGPT Account (reducing the balance).
3. The user may request reimbursement of funds deposited into the PulsGPT Account at any time, in any amount not exceeding the balance of the PulsGPT Account, taking into account payments and top-ups made by the user. This request is sent using the chat function.
4. Refunds from the PulsGPT Account will be made without undue delay by PulsGPT by transferring them to the bank account from which the payment was made, or considering the method of payment used.

1. The user has the right to use the Service according to its purpose, complying with the law and good manners of the information society, respecting the rights and interests of other individuals. Specifically, the user is obligated to:
   a. Not engage in actions that could interfere with the normal functioning of the Service, including not interfering with the content of the Service, their own Account, other users' Accounts, or the information-technical elements of the Service;
   b. Not engage in illegal actions, including not using the functionalities of the Service to transmit or publish materials that violate the law and personal rights, content of a terrorist nature, containing or disseminating child pornography, infringing on the intellectual property rights of others, as well as discriminatory or racist content;
   c. Refrain from dishonest actions, misuse of the Service's functionalities, and using the Service contrary to its purposes and the Rules.
2. The user is obligated to comply with the responsibilities listed in section 11.1 of the Rules at every stage of using the Service, for each offered functionality, including sending messages to other Users.
3. In case of a serious violation of the law during the use of the Service, as well as serious or repeated violations of the Rules, particularly in cases of attempts to spread illegal content by a specific User or Users acting in concert, including the use of various Accounts, PulsGPT may, according to the principles of proportionality and respect for freedom of expression, refuse to refund the money previously paid for Paid Services related to the Bot in question, suspend, temporarily or permanently block the Account or Accounts, which will be equivalent to a temporary cessation of service provision to the User with the following rules:
   a. Suspension of the Account means a temporary cessation of its operation. The user whose Account has been suspended loses the ability to actively use the Service, meaning they cannot send messages using its functions. However, you can view the Service, message history, and published Ads, and deposit funds into the PulsGPT Account, but to withdraw designated funds you should contact customer support.
   b. Blocking the Account means that the User loses the ability to log into it.

1. PulsGPT reserves the right to make changes to these Rules while adhering to the following principles:
   a. Changes to the Rules may relate to organizational, legal, or technical issues, as well as tariffs and conditions for the provision of Paid Services;
   b. Users will be informed of each change by posting information on the relevant page of the Service.
   c. Amendments take effect within the period specified by PulsGPT, no less than 15 days from the notification of changes in the Rules, unless otherwise provided by generally accepted legislation;
   d. Changes cannot restrict or deprive the user of rights related to acquired Paid Services. Paid Services purchased before the changes to the Rules take effect will be provided on the existing principles.
2. Provisions of the Rules in their current edition apply to Paid Services that are active until the date the new Rules take effect.
3. A user who does not accept amendments to the Rules has the right to terminate the service agreement for their Account at any time.
4. The law of Ukraine prevails unless otherwise provided by mandatory provisions of the law and norms that may apply to agreements between the User and PulsGPT. Choosing the law of Ukraine does not deprive the Client of protection provided to them under provisions from which it is not possible to derogate by agreement and by the law applicable in the absence of choice.
5. All disputes related to the provision of services by PulsGPT within the framework of the Service should be referred to the competent courts of general jurisdiction.
